For Kesitilwe, tackling the illegal market is not just a regulatory priority but a fundamental player protection issue.

“Oftentimes when you see governments increasing taxes, banning iGaming, it’s mainly because of illegal operators because they don’t comply,” he declares. “An illegal operator may not provide age verification, responsible gambling tools, secure treatment of player funds, or an effective complaints mechanism.

Hip‑hop producer Jamal “Mally Mall” Rashid was ordered back to federal prison Thursday (Sept. 17), after a Las Vegas judge found he repeatedly violated the conditions of his supervised release.

Rashid received a 17‑month sentence following a hearing in U.S. District Court, where he admitted to a series of breaches that prosecutors said showed he had not reformed.

In 2021, Judge Gloria Navarro sentenced Rashid to 33 months at the Federal Correctional Institution in Sheridan, Ore., followed by three years of supervised release after he pleaded guilty to one count of using an interstate facility in aid of unlawful activity—specifically, a prostitution service.

Yet Dan Waugh, partner at Regulus Partners, pushes back against the idea that enforcement notices reveal a fundamentally non-compliant sector.

“Operators failing compliance checks is never a good look,” he says. Campaigners often claim that financial sanctions are priced in and that the Commission should revoke more licences, although Waugh does not believe operators view settlements merely as a cost of doing business.

Nor are regulatory breaches unique to gambling. Waugh notes that Tesco was fined more than £8 million for food hygiene failings in 2021, without parliamentarians demanding that it should be prevented from selling cornflakes.
